Was muss ich zu den Mieteinnahmen wissen?

Als Vermieter müssen Sie die Kaltmiete sowie die auf die Mieter umgelegten Nebenkosten als Einkommen versteuern. Die dabei entstehenden Kosten können Sie als Werbungskosten von der Steuer absetzen.

Beispiele für Mieteinnahmen

Zu den Mieteinnahmen gehören unter anderem:

  • Mieteinnahmen für Wohnungen oder Zimmer
  • Mieteinnahmen für Garagen oder Stellplätze
  • Nebenkosten, die auf den Mieter umgelegt wurden
  • Miete für Reklameflächen und Automatenstellplätze
  • Guthabenzinsen aus Bausparverträgen
  • Abstandszahlungen von Mietern bei vorzeitigem Ende des Mietvertrags
  • Pachten für unbebaute Grundstücke
  • Einnahmen für ein Erbbaurecht
Steuerfreibetrag bei geringen Mieteinnahmen

Wenn Ihre jährlichen Mieteinnahmen unter 520 Euro liegen, beispielsweise durch eine Untervermietung, können Sie auf die Angabe in Ihrer Steuererklärung verzichten. Diese Einnahmen, die aus einer vorübergehenden Vermietung stammen, sind von der Einkommensteuer befreit. Das gilt auch für die vorübergehende Untervermietung von Teilen der eigenen Mietwohnung. In diesem Fall können jedoch auch keine entsprechenden Werbungskosten abgesetzt werden.

Based on the information you provide, the tax office will determine how high the rent per square metre is and whether it is a discounted rent.

When determining the living space, additional rented rooms, such as cellars, attics, sheds and garages, are not to be taken into account.

Room parts with a clear height of between one and two metres as well as the area of balconies, loggias and roof gardens are to be calculated at half.

Allocations / additional costs include:

  • Tax on land and buildings.

The additional costs can - at least partially - be allocated to the tenants. In this case, the allocated costs are to be recognised as income. On the other hand, you may claim the costs incurred as income-related expenses (Federal Fiscal Court's (BFH) judgement of 14.12.1999, BStBl. 2000 II p. 197).
